When you need a Building Permit

It is important to check before you start building works to ensure you have the necessary permits.

There are many types of renovation, alteration and building works that require a permit. 
Please see the drop down boxes below for common items that may need a permit.

Building Regulations 2006 specify that the need for a Building Permit is based on the scope of building work rather than the value of work, which means structures such as garages, carports and pergolas need a Building Permit.

You will need a building permit for additions to a dwelling or any other building.

You need a building permit for structural alterations to a dwelling or any other building.

You need a building permit for the removal of or alteration to a load bearing part of the building.

You need a building permit for the construction of a carport or garage larger than 10 metres squared in area.

You do not need a building permit for the demolition of a freestanding carport or garage, provided it meets the below criteria:

  • is not constructed of masonry;
  • is no more than 40 metres squared in floor area;
  • is not a building on the Heritage Register, or covered by a Heritage overlay in the planning scheme;
  • the work being done will not adversely affect the safety of the public or occupiers of the building.

You require a building permit for any side or boundary fence that is above 2m in height.
You require a building permit for any fence that is more than 1m in height, that is within 9m of the point of intersection street alignment.

You do not require a building permit, for the below items.

  • Construction of side or boundary fence less than 2m high, and not within 3m of a street alignment.
  • Construction of a brick front fence less than 1.2m high, and not within 9m of the point of intersection street alignment.
  • Construction of a timber front fence less than 1.5m high and not within 9m of the point of intersection street alignment.
  • Construction of a chain wire tennis court fence.

You do not require a building permit unless the mast / antenna will be 3m above the highest point of a building, or if it's 8m above the ground free standing.

You require a building permit of a pergola if it is located further than 2.5m forward of your front most dwelling wall.

If the pergola is less than 3.6m high, and 20 metres squared in area, you do not require a building permit.

You require a building permit for all re-blocking or re-stumping of an existing building.

You require a building permit if the retaining wall will be within 1m of any boundary lines.

You require a building permit if the retaining wall is taller than 1m.

You require a building permit if you are replacing your existing corrugated iron roof, with concrete or terracotta roofing tiles.

You do not require a building permit if you are replacing your existing corrugated iron roof, with Colorbond or other pre-finished sheeting.

You require a building permit if the shed you're building has more than 10 metres squared in floor area.

You will not require a building permit if the shed you're building fits the below criteria:

  • Less than 10 metres squared in area.
  • 3m or less in height, or if situated within 1m of a boundary, is no more than 2.4m in height
  • Not further forward than the front wall of the dwelling

You require a permit if your sign meets any of these criteria:

  • More than 1m in height, and within 3m of the street alignment
  • More than 8m above ground level, and more than 6 metres squared in display area

You will require a building permit for the construction of an in-ground or above-ground swimming pool/spa greater than 300mm in depth

You will require a building permit for any verandah that is attached to any existing building.

You require a building permit if you are adding or removing windows.

You do not require a building permit if you are replacing the window, where no alteration of the opening is required.

You do not need a building permit to install a wood heater / solid fuel burning appliance.

It however must be installed by a licensed plumber.
